These terms of service govern the use of the website http://www.compando.ch as well as the content, functions, and services offered therein by Compando.ch GmbH (hereinafter "Compando").
By accessing the website or using individual services, you agree to these terms of service.

These terms of service apply exclusively to adults with legal capacity and companies. The use of the platform by minors is not permitted without the consent of their legal guardians.

1. Object of the Services

Compando operates a digital platform for comparison, consulting, and mediation of insurance, pension, and other financial solutions for private individuals, self-employed persons, and companies in Switzerland.

The services can include, in particular:

  • Provision of information, comparisons, and market overviews
  • Analysis of needs and options
  • Obtaining and mediating quotes
  • Personal, telephone, or digital consultation
  • Mediation of insurance and pension solutions
  • Forwarding of inquiries to suitable cooperation partners or registered intermediaries
  • Administrative support and general customer care

Compando can work with external partner companies, insurers, product providers, brokers, or – as far as necessary – FINMA-registered intermediaries to provide the services.

2. Regulatory Information

Compando is entered in the public intermediary register of the Swiss Financial Market Supervisory Authority FINMA as an independent insurance intermediary.

3. Non-Binding Nature of Website Content

The content published on this website serves for general information and does not constitute a binding offer, assurance, investment advice, legal advice, or individual recommendation unless expressly agreed otherwise in writing.
Information on products, services, premiums, conditions, or market comparisons are partly based on third-party sources and can change at any time. Massgebend sind ausschliesslich die jeweils gültigen Vertragsunterlagen, Policen und Bedingungen des betreffenden Produktanbieters.

4. Consulting Services / Delimitation

Compando provides individual consulting services (personal, telephone, or digital) in addition to general platform use.

The following basic rules apply to these:

  • Individual consulting services require a separate consulting mandate or are provided at the express request of the customer.

  • Compando is liable for consulting errors within the framework of the statutory provisions and the existing professional liability insurance.

  • General website content does not establish a consulting relationship. The liability exclusions in section 9 apply exclusively to general platform use, not to agreed consulting services.

5. Conclusion of Contracts

The use of the website alone does not establish a consulting, mediation, or insurance contract.

A contract is only established:

  • By express written agreement with Compando; or
  • By concluding a contract with an insurer, product provider, or partner company.

Insurance contracts are usually concluded directly between the user and the respective insurance company. Compando is fundamentally not a party to the insurance contract unless expressly agreed otherwise in writing.

6. Contact Inquiries / Consent to Contact

If users submit an inquiry via the website, Compando can process it itself or forward it to suitable cooperation partners, consultants, or registered intermediaries. With the submission of an inquiry and the consent to the privacy policy, users agree to the processing of their inquiry and to being contacted by telephone, e-mail, or another suitable communication channel. Marketing communication only takes place within the legally permitted framework or with separate consent. There is no claim to mediation, feedback, offer, or conclusion of a contract.

7. Compensation / Conflicts of Interest

Compando is compensated for mediation and consulting services by insurance companies and cooperation partners in the form of brokerage fees, commissions, or lead fees. These are included in the offered premiums. The customer usually does not incur any additional direct costs. As an independent intermediary, Compando is independent and not bound to individual insurance companies. On request, the specific amount of the compensation as well as any conflicts of interest will be disclosed.

8. Obligations of Users

Users commit:

  • To provide truthful and complete information
  • Not to transmit any unlawful or abusive content
  • Not to perform any technical interventions, manipulations, or disruptions
  • To treat access data confidentially, if user accounts exist
  • To respect the rights of third parties

Compando is entitled to restrict or block abusive inquiries or use without prior notice.

9. Liability

Compando is liable within the framework of statutory regulations for damages caused by intentional or grossly negligent behavior. Soweit gesetzlich zulässig, wird die Haftung für leichte Fahrlässigkeit ausgeschlossen.

No liability exists – as far as legally permissible – especially for:

  • Indirect damages or consequential damages
  • Lost profits
  • System failures, data loss, or technical interruptions
  • Content or services of third parties (partner companies, insurers, intermediaries)
  • Decisions made by users based on general website content
  • Non-conclusion of contracts with third-party providers

These liability limitations apply exclusively to general platform use. Compando is liable for agreed individual consulting services according to the statutory provisions and the existing professional liability insurance.

10. Right of Withdrawal

For private individuals, a right of withdrawal may exist for distance contracts according to the applicable statutory provisions.
Compando primarily provides mediation services. An independent contract with Compando is only established by express written agreement. Allfällige gesetzliche Widerrufsrechte bleiben unberührt.

11. Intellectual Property

All content on the website – in particular texts, logos, brands, designs, images, software components, databases, and graphics – is protected by copyright or other rights.

Without the prior written consent of Compando, content may neither be reproduced, distributed, made publicly accessible, nor used commercially.

12. Data Protection

The processing of personal data is governed by Compando's separate privacy policy in its respectively valid version.

13. Changes to Services and Terms

Compando can adjust content, functions, services, and these terms of service at any time.
In the case of significant changes affecting current consulting mandates, affected customers will be informed with a reasonable notice period.
The respectively current published version applies to general website use.

14. Severability Clause

Should individual provisions of these terms of service be or become wholly or partially invalid, the validity of the remaining provisions remains unaffected.
In place of the invalid provision, a legally permissible regulation applies that comes as close as possible to the economic purpose.

15. Applicable Law / Jurisdiction

To the extent permitted by law, all legal relationships between users and Compando.ch GmbH are subject exclusively to substantive Swiss law.

The exclusive place of jurisdiction is Bern, Switzerland, unless mandatory statutory provisions state otherwise.
